just got a freelander and it has no rear prop

hello everyone. i have recentley got a freelander 200 td 99 v reg and while repaceind the pads i found that the rear prop shaft has been completley removed from transfer box to diff. can anyone shed some light on why this my have been removed and were can i get one, many thanks chris
 
Suspect that the previous owner had a problem with a failed VCU and instead of spending any money just took the whole lot of.

In the meantime it is perfectly safe to drive it as it is, just be aware that you get some oversteer and can't take off quite so quickly. Oh and don't go too far offroad!

Hope you are going to "persue" the seller?
 
Unless the seller notified you that it wasnt there I would be looking for some kind of compensation. Can't say I would be in the best of moods if that happened to me!

ive also heard that when the vcu goes that it can cause damage to either the transfer box or rear diff

If it was a private sale, how do you know that the seller knew the prop was there or not? It's just been bought without the prop by the buyer. If the seller has no mechanical knowledge, you have to prove he misled you. If it's from a Dealer, you have reason for recompense.

If I were to sell a vehicle, whether Privately or through work, a Court would more than likely find against me, as I would be expected to know what is missing and why. If I said the prop was taken off for a reason and you bought the vehicle, then I would be OK as I had informed you of the fact.

got the freelander from a dealer and been back,he gave me two options:1 to find a prop and let him fit it cos i like the jeep. :2 he will take the freelander back on a swop with a w:reg tata diesel safari but he says it now not wort wot i gave him for it and i dont think that tata,s are all that good are they??

Tata's rubbish.

The vehicle is clearly not fit for purpose and not as described because it's not a 4X4!!!!!. I would negotiate a return and refund that takes into account any mileage you've put on it.

How long ago did you buy the Freelander?
 
Don't touch the Tata.

If the Dealer sold you the vehicle as a 4wd, then HE must supply you with the parts. If he told you it was only 2wd, then you must pay.

and if he refits the prop you'll probably find that the VCU is knacked - at which point he says - that wasn't happening when I sold it to you mate - fair wear and tear. Negotiate your way out now before it costs serious money.

On the up-side, the small claims court is easier than ever to use and the law changed in 2005 taking the onus off the customer to prove a fault was there at sale, onto the seller to prove it wasn't there. In this case it might be a bit tricky.

If he doesn't play ball I'd take it to a reputable garage for an inspection report. Slap that back on him with a demand for partial refund, minus the interim use you've had plus the cost of the inspection.
 
got it on the 15/11/06 and payed 3495 with 98000 on and never said it was 2wd so i did not ask as its not some thing you think of as it is perm 4wd
 
the complete prop must have been of when i got it as he thinks some one has stolen it but they would need to acsess it to be able to rotate the wheels to get all the bolts out of both flanges and it sleeps on the road side
 
If someone has stolen it, that's his problem.

You paid for a 4x4, you want a 4x4. If he won't make it back to standard, he is in breach of the Consumer Laws.

Trading Standards will act in this case. He is not taking reasonable action.

Thats a pathetic excuse for a dealer.. Sorry! As the other guys say, sounds like it may have more problems than just the prop.

Try and get a good amount of your money back. May be worth mentioning that it could have had an impact on safety/road holding blah blah blah, and that your wife/gf drives it and you have put her life in danger.

May make him a little more passive?
 
Get around to Trading Standards first thing tomorrow and tell them what has happened, then go back to him and demand ALL your money back, under The Sales of Goods Act, on the grounds that "the goods were not of merchantable quality, and not as described"

If he refuses, write a letter, by recorded delivery, giving him 14 days to pay up, or you will take him to the Small Claims Court. DO NOT USE THE CAR IN THE MEANTIME.

As a dealer, is he with any large franchise? Is he a member of the Trade Assoc? Is he well known? f yes, get on to the local papers, radio, TV, etc, if he wont play ball.

Don't know where you are in the country, but it is useful putting that in your Profile.
 
i have just been on ebay all the parts u need are on their buy them and let the garage u got the hippo off fit them and give them the bill for the parts.I bought a second hand prop for 40 pounds and a vcu for 38pounds and it all works no problems
 
Personally I dont think that you should ask them to put new parts on because it may reveal other problems. Unless you can get them to agree to pay to fix any thing wrong with the transmission VCU etc.
I will be interested to hear what the dealer has to say for themselves as this sounds appalling what they have done.

You didnt buy it from Shardlow Landrover (Rob & John Greeves) did you.....sounds like their tricks.

You do not have to accept their offer of another vehicle, you can expect to get full recompense including any out of pocket expenses, or if you do want the vehicle you can get all items repaired or replaced even with no warranty.

I bought my FL 18 months ago....big trouble with dealer. Cost dealer in excess of £5k to put right in the end.

Will dig out a contact from trading standards who was good help and post on here later

Got to dissagree with advice...Dont spend a penny.....Especially on used parts...As someone said earlier it is probably to hide the fact the rear diff or IRD has gone and vehicle will need proper inspection.

Any info you feel you cant post on here then feel free to PM and will talk you through process of getting your car into fit state or full refund without it costing YOU money.
 
I concurr. This is the dealers problem.

If they propose sourcing and fitting the parts, and the vehicle can then be tested and inspected by a Land Rover specialist, then I would accept their offer.

Otherwise, you deserve your money back.

i wont be buying any bits for it from ebay as ive not got the trust that the parts are i a serviceable condition and belive that recon parts would be a better choice plus i now belive the best thing to do is get money back and buy another one from some one else
