Engine died- crank shaft fault

Hi All,
Similar to most people on this forum, I too experienced a catastrophic crankshaft failure on my 2012 Discovery 4 HSE after 104,000kms on the clock (64,000 miles). Despite a series of technical diagnostics that concluded that indeed the crankshaft failed, Land Rover Australia have decided not to accept any liability or show any good will. Their position is that it is out of warrenty so bad luck.
I'm taking the case to the State ombudsman and it is my hope that they will rule that I as the consumer should reasonably expect a crackshaft to perform for longer than 104,000 kms, given there's a full service history and no early failure signs.
Can anyone tell me how many crankshaft failures this particular engine has had? I am aware of the Technical Service Bulletin but don't have any hard numbers regarding the size/frequency of the problem.
Also, I'd be more than happy to join a collective legal process.

crank shaft on my 2012 RRS SDV6 160,000kms went this week - did you have any luck with compensation?

For me on a 2014 41K Miles FULL LR SH in short I got a big FO, too old cost me £13599 at a dealer but 2yr parts n labour on it and didnt need a service or belts servic this year! (gotta think of the positives!)

I'm going to be contacting LR again about it as several others I have spoken with seem to get some assistance, one guy bought his as an ex demo hasnt had it serviced by a dealer for the last few years and got hi engine repalced at a non LR approved garage (who serviced it for him) and still got £1900 back and another guy on a forum who had a 2014 Disco got the lot covered! so its hit and miss on support from LR and as yours is the old model I wouldnt hold much hope, mine is acutally a 2013 showroom model near the launch but has never been out fo the dealr network is fully loaded and near mint but still got nothing! My 2015 Range Rover sport has done exactly the same thing today but it did pay for extended warranty and Land Rover are fitting a new engine free of charge

We should find out Tuesday /Wednesday if they will offer any good will . We only brought the car 11 Months ago . We don’t have any warranty on it but still hoping they offer to pay atleast 80% . If they say no I will taking it further . So so gutting that this has happened :(

I really hope they do , would you say it’s in our favour if the approved car dealer put the claim in for us ? They done a claim 6 months ago for another person that had the same issue and LR paid out 80% .

Then I would say yes I should imagine they have more poke than you would have .they know what to say ..good luck with it let us know how you get on .

So Ben from Land Rover Rang today to say it had gone through the tier 1 approval, and that the evidence provided is consistent of that they have experienced with recent engine failures (which is good news).
Now it goes through tier 2 where they will look more closely at the chassis range and engine number to ascertain if your vehicle was fitted with any components that may have caused any known issues. They will also consider the age and mileage as to whether they will contribute to a repair of which Ben advised you should know by Tuesday.
I hope that helps, it’s a pain it’s taking so long, but if they offer to put their hand in their pocket that is the best outcome you could ask for 🤞🏻🤞🏻

Yep but when they quote, even with the JLR contribution, I bet it'll still be cheaper to get it done by an independant specialist like NWS, fingers crossed but seen it too many times :(

Sorry another thing I should mention is the crankshaft is still intact because i pulled over so quick as soon as the noise started . They have said if I had driven it any longer it would of snapped while I was on the motorway 😩 the whole experience has been absolutely horrendous. I was stuck on the roadside with my 5 month old son for 4 hours 😓
For anyone that has had success with help from LR been offered a courtesy car ?

Fingers crossed, if its only 3k you'll have done well. A recon unit costs about that plus fitting.

Thats an interesting admission that they would seem to be aware of specific components that have known manufacturing faults... o_O

I have been offered 40% . I think I’m going to dispute it and ask for more . It’s going to cost me £7500 😩
 
I would dispute it if they offered to pay 40% then that’s like admitting liability…that’s to much money .🙁
I’m going to call LR in the morning. I thought that too . By offering the 40% means admitting its faulty. He said they checked the chassis number and it’s come back that my car has the common fault . Also been told there is a back log for the new engine so could be waiting weeks just to even get the engine then longer for them to fit . Been told around 4 to 6 weeks . Do you think they can offer some sort of courtesy car (or am I pushing my luck) lol.

Well there’s no harm in asking .they should stump up the whole total if the guy has told you they have the common fault .at the end of the day your going to get a new engine so the wait is worth it .try for the courtesy car there’s no reason they shouldn’t seeing as they’ve admitted it ..ask for the reply he gave you in writing..🙂
 
Might be worth taking legal advise or trading standards now they've admitted it's a known 'commen' fault. I suspected this would happen though seen it many times, inflate the end price, say theyre covering 40% to look good when in reality I reckon you're covering their costs.
